Terms and Conditions

By accessing and using Roots Travel services, the Client accepts to be legally bound by the following terms and conditions detailed below.

1. Booking

The travel booking will be confirmed by Roots Travel upon receipt of 50% of the total cost of the land package and/or itinerary, plus 100% of the cost of flights. All flights included in the itinerary, whether domestic or international, must be paid in full to secure availability.

2. Contract

The confirmation of the booking shall be binding between Roots Travel and the Client, constituted by the individuals listed on the booking form. The person signing the booking form guarantees that they are duly authorised by the persons whose names are included therein, declares that such persons are aware of the trip, and that they accept its terms and conditions.

3. Prices May Include

The services specified in the contracted itinerary, such as: round-trip transportation when expressly included in the service details, with the type, characteristics and category stated therein, whether the service is regular, charter, or block-off system, and according to destinations with or without stopovers and/or connections; travel assistance if contracted; accommodation in the hotels described in the itinerary, or others of equal or higher category in the event of a change, in single, double or triple rooms according to the number of passengers, with private bathroom and taxes included, except where otherwise stated and/or in locations that charge overnight taxes directly to the passenger; meal plans as indicated in each case; visits and excursions mentioned; transfers to and from airports, terminals and/or hotels when indicated. The number of accommodation days as stated in the service voucher, taking into account that hotel check-in begins at 3:00 p.m. and ends at 12:00 p.m. the following day, regardless of arrival or departure time and/or use of hotel services. However, as hotel regulations are governed by local legislation, the check-out time set by the accommodation at the time of check-in shall apply, and may even be earlier than 12:00 p.m., and Roots Travel is not responsible for or able to modify such conditions. The duration of the tour shall be specifically indicated, with the first day being the one established in the travel documentation and the last day being the departure day from the destination.

4. Services and Items Not Included

Extras, meals not specified, en-route food and beverages, tips, laundry and ironing services, telephone calls, boarding fees, excess baggage charges, penalties for failure to complete online check-in, tolls, service taxes, VAT and/or other taxes, customs, immigration or reservation management fees, seat selection charges, costs and/or expenses for vaccinations, tests and/or biochemical analyses and/or any expenses arising from health requirements of each destination, withholdings or perceptions, expenses for urgent processing of travel documentation, and any other service not expressly specified by ROOTS TRAVEL. Interest on credit operations, entrance fees to museums, attractions, national parks and excursions, tourism taxes and/or fees, delays in transportation, visa and/or entry authorisation costs to the destination. Expenses arising from the extension of services or stays at the passenger’s own request, or due to force majeure or unforeseen events, are also excluded. Fuel costs, tolls, GPS, taxes, franchise fees or deductibles for accident, damage, theft, and optional or mandatory insurance are not included. Travel assistance service is not included unless expressly contracted.

5. Payment

The balance of the total cost of the trip/land package must be paid to Roots Travel at least 30 days prior to the start of the trip. Failure to settle the outstanding amount within this period will result in the booking being considered cancelled by the Client. For reservations made less than 30 days prior to the departure date, full payment will be required for confirmation. All prices are quoted in United States Dollars (USD), and all payments must be made in that currency or its equivalent according to the MEP dollar exchange rate of Banco Nación, based on the exchange rate at the time of booking.

5. Changes and/or Cancellations by the Client

a) Changes

If the Client wishes to make any changes to a confirmed booking, such request must be made by the person who signed the booking form. Roots Travel will endeavour to implement the requested modifications; however, availability cannot be guaranteed. Any additional costs or charges resulting from such changes shall be borne by the Client.

b) Cancellations

Cancellations may be made at any time provided they are communicated in writing to Roots Travel. Once received and confirmed, cancellation charges shall apply according to the following retention policy, calculated from the date the written notice is received: Cancellation up to 30 days before departure: 30% of the total package value + flights Cancellation 29 to 15 days before departure: 50% of the total package value + flights Cancellation from 14 days before departure up to the start date: 100% of the total package value + flights

c) Cancellation Policies for Special and/or Specific Products

These will be communicated at the time of confirmation: Air tickets: Refunds are always subject to the airline’s conditions. Cruise tickets: Refunds are always subject to the cruise line’s conditions. Special and/or specific products: Refunds are subject to the applicable conditions. Packages/products for special or holiday dates: Refunds are subject to the special conditions established. Special conditions apply for groups of 10 or more passengers.

7. Changes and/or Cancellations by the Company

Roots Travel undertakes to carry out tours as published; however, by entering into this contract, the Client accepts that it may be necessary or advisable to vary or modify an itinerary or its content due to prevailing local conditions. Roots Travel reserves the right to cancel or modify at any time any of the services or prices comprising the itinerary (including flights, accommodation or other services) and to substitute them with alternative arrangements of comparable monetary value without any compensation, and without accepting liability for loss of enjoyment resulting from such changes. If a significant change is known at the time of booking, the Client will be informed accordingly. In such case, the Client shall have the option to accept the change, purchase another available itinerary, or cancel and obtain a full refund, provided that the change is not due to force majeure. 'Force majeure' shall mean situations of war, threat of war, riots, civil unrest, industrial disputes, terrorist activities, pandemics or public health emergencies, natural or nuclear disasters, fires or adverse weather conditions, technical or maintenance problems in transport, changes arising from flight cancellations or rescheduling by an airline, change of airline or aircraft type, or other similar events beyond reasonable control. Roots Travel shall not be liable for any charges in the event of changes due to force majeure affecting the departure time or date of any tour, flight or other means of transport.

8. Passport, Visa and Vaccination

Roots Travel informs that it is the Client’s responsibility to hold valid identification documents and/or passport, visa permits, vaccinations and travel assistance as may be required for the duration of the trip. Roots Travel shall not be held responsible for the absence of any of the aforementioned requirements.

a) Age Requirement, Medical Fitness or Disability Certificate

Bookings for minors under 18 years of age: Only bookings for minors travelling with the adults exercising parental responsibility, or who hold a valid travel authorisation issued by the competent authority, will be confirmed.

b) Health Condition Declaration

Clients must ensure that their health and physical condition are suitable for the selected itinerary prior to confirming the booking. Any person suffering from illness or disability, or undergoing treatment for any medical or physical condition, must declare the true nature of such condition at the time of booking and make all necessary arrangements for the provision of medication or other treatments required during the trip. Failure to make such disclosure shall constitute a breach of these terms and conditions and may result in exclusion from the tour, in which case all amounts paid shall be forfeited. For maritime excursions, the Client must inform whether they can swim.

c) Medical Fitness Certificate Due to Age or Health Condition

A medical fitness certificate may be required for persons over 60 years of age and/or those whose condition or health status so requires, in accordance with the needs of the travel itinerary. Roots Travel representatives (guides, etc.) shall have the authority to request that the Client refrain from participating in part or all of a tour if they consider such participation to pose a risk to the safe, comfortable and satisfactory conduct of the trip.

9. Claims

Should the Client wish to file a claim, they must notify Roots Travel immediately upon the occurrence of the issue. If the problem remains unresolved, a formal claim must be submitted to Roots Travel within 28 days following the conclusion of the trip.

10. Liability

Roots Travel undertakes to ensure that the trip booked by the Client is provided as described in the final version of the travel programme received upon arrival and that the services meet reasonable standards. Roots Travel acts solely as an agent and, while taking every reasonable precaution, shall not be held responsible for injury, illness, damage, loss, additional expenses, accidental delays or any other irregularities caused by deliberate or negligent acts or omissions by companies or individuals providing or involved in transport, accommodation or other services related to the trip, or by natural disasters, social disturbances or other causes beyond its control.
